I disagree. In this case, the UI guidelines make a lot sense. When you have a long submenu, it is much easier to pick out the items which are at the top and the bottom. For instance, here is the order we use in EquationBuilder:
Info Panel...
License...
Legal...
Suggestion...
Gallery...
(Show Menus would have gone here if we had implemented it)
Preferences...
Help... ?
A quick survey of the apps I am running only shows a single one that does not follow the above convention (Help and Preferences are reversed in NXFax Monitor). If other apps have the order you describe, I would suggest that this was most likely because the developers were not aware of the UI guideline on menu order, rather than some conscious design decision.
If a convincing case can be made for some other arrangement, I would suggest lobbying NeXT for a change in the UI guidelines, rather than making unilateral changes. (As an aside, the UI guidelines for NS are wonderfully written, and well worth a read if you have never bothered)
